Terms and Conditions

1. The Promoter

1. The competition detailed in these Terms and Conditions is a single competition which is being promoted by lastminute.com with its registered office at 39 Victoria Street, London SW1H 0EU (“lastminute.com”) (“Competition”). The Competition is in no way sponsored, endorsed or administered by Facebook.  Any questions, comments or complaints regarding the Competition must be directed to lastminute.com.  

2. Restrictions on Entry

2.1. Subject to Paragraph 2.2 below, the Competition is open to all persons who are residents or permanently living in Northern Ireland or the Republic of Ireland and are aged 18 years and over.

2.2. The Competition is not open to employees or agents (and their family members) of lastminute.com or any of its affiliated companies, or any other person connected with the management or provision of the Competition or the Prize (see clause 6.1 for description of Prize).

2.3. No purchase is necessary to enter the Competition.

2.4. Entrants in the Competition cannot make multiple entries in the Competition. Entries made on behalf of another person will not be accepted and joint submissions are not allowed.

2.5. By submitting an entry to the Competition, entrants will be deemed to have accepted and agreed to be bound by these Terms and Conditions.

3. How to Enter

3.1. In order to enter the Competition, potentials entrants must visit the Hotel Experts webpage and follow the instructions provided.  Potential entrants may also access the Competition Site via www.facebook.com/lastminute.com or www.IrelandHotelExperts.com (with together with the Competition Site shall be referred to in these Terms and Conditions as the “Sites”).

3.2. After having completed the entry process, entries will be entered into the Competition.

4. Rejection of Entries

4.1. lastminute.com shall be entitled to discard any entry that: a. is submitted after the Closing Date (see clause 5); b. which requires a proof of permission to enter but that proof cannot be obtained; or c. is in breach of these Terms and Conditions.

4.2. No responsibility is accepted by lastminute.com for any incomplete or inaccurate entries or for matters beyond its control.

4.3. All entries will be subject to moderation and lastminute.com reserves the right to reject entries (or remove any reference to such an entry from any form of publication whether electronic or otherwise) deemed, in lastminute.com’s sole discretion, to be inappropriate.

5. Time to Enter

5.1. Entries may be submitted from 06th Dec until 17:00hrs on Friday 09th Dec 2011. In the event that lastminute.com amends the Closing Date, entrants and potential entrants in the Competition will be notified of this on the Competition Site.

6. Selection of Winners

6.1. The Prize winner will be drawn at random by lastminute.com within 72 hours of the Closing Date. The winner of the Prize will be announced on one or more of the Sites.  The winner of the Prize will also be contacted by email by lastminute.com (or lastminute.com’s agent) within 48 hours of the winner having been decided.  If the winner does not respond within 24 hours of being contacted by lastminute.com, lastminute.com reserves the right to forfeit the allocation of the Prize.  

7. Publicity and Identity of the Winners

7.1. The entrant that wins the Prize may, at lastminute.com’s option, be required to participate in publicity accompanying or resulting from this Competition. Entrants in the Competition accept and agree that lastminute.com has the right, without any additional payment or permission, to use a winner’s Competition entry and/or any information provided by the winner, in any way related to the Competition.  In particular, by submitting an entry to the Competition, entrants give lastminute.com the right to use their name for the purpose of identifying them as the winner of the Competition.

8. Competition Prizes

8.1. The following prize is to be won in this Competition:

• Two nights for 2 people at the 5* Conrad Dublin;
• Dinner on one of the nights.
• Breakfast both mornings.

(“Prize”).

8.2 All Prizes are non-transferable, non-refundable and non-changeable. Cash or credit alternatives will not be offered. lastminute.com may substitute the Prize with a prize or prizes of a similar value in its absolute discretion. No transfer or assignment of the Prize is permitted under any circumstances.

9. Prize redemption terms and conditions:

9.1. Maximum value of Prize: £2000

9.2. The Prize will be valid for redemption until the date which is 6 months from the date on which the Prize has been claimed by the Prize winner. Prize redemption dates are subject to availability. Any other restrictions relating to the Prize will be posted on the Competition Site.  

9.3. The Prize has no cash or refund value except when redeemed in accordance with these Terms and Conditions. The Prize cannot be returned for cash or its equivalent.

9.4. Entrants in the Competition accept and agree the redemption of the Prize may also be subject to the terms and conditions of the entity supplying the Prize to which they must also comply.

9.5. Other than the discount available through the provision of the Prizes (description of Prize at clause 8), lastminute.com shall not be responsible for any other cost or any other related charge or expense incurred by a winner (or their companions where applicable) or any entrant in the Competition.

9.6. Winners of the Competition (and their companions) shall be responsible for organising all transfers, and obtaining insurance, valid passports and visas and, where necessary, for obtaining appropriate vaccinations and inoculations. It is strongly recommended that winners (and their companions) take out adequate travel and medical insurance.

10. lastminute.com’s Liability

10.1. To the fullest extent permitted by applicable law, and with the exception of liability arising either from fraud, or from death or personal injury caused by the negligence of lastminute.com or its employees, lastminute.com excludes all liability howsoever arising connected with the Competition, Prize and all warranties, conditions, undertakings, terms and obligations implied by law (whether by statue, common law or otherwise).

10.2. Subject to Paragraph 10.1, lastminute.com’s total aggregate liability to all entrants in the Competition in relation to the Competition shall be the amount listed at clause 9.1.

11. Modification of the Competition or the Rules

11.1. lastminute.com shall be entitled to terminate or modify the Competition or modify the Terms and Conditions at any time by publishing any such modification or termination on the Competition Site.  

12. Disputes

12.1. In the event of a dispute, the Competition judges’ decision shall be final and no correspondence will be entered into.

13. Governing Law and Jurisdiction

13.1. This Competition and these Terms and Conditions are governed by and shall be construed in accordance with the laws of England and Wales. Entrants in the Competition and lastminute.com agree that the courts of England and Wales have exclusive jurisdiction to settle any dispute or claim that arises out of or in connection with the Competition or these Terms and Conditions.
